2. Scope of These Terms
These Terms and Conditions govern all purchases of artworks (including but not limited to paintings, prints, photography, and sculpture) made through MortonContemporary.com, as well as general use of this website. By placing an order or using this site, you confirm that you are at least 18 years of age and have the legal capacity to enter into a binding agreement.
3. Prices and Product Listings
All prices are listed in U.S. dollars. Prices do not include applicable taxes or shipping and handling fees, which will be calculated and displayed at checkout. Artworks are billed at the price in effect at the time the order is placed. Morton Contemporary reserves the right to correct pricing errors and to adjust prices at any time without prior notice.
Morton Contemporary makes reasonable efforts to accurately represent artworks on this site; however, colors, dimensions, and details may vary slightly from what is shown due to monitor settings and photographic conditions. All product descriptions and imagery are provided in good faith but are not warranted to be error-free.
International Orders: If you are ordering from outside the United States, you are the importer of record. You are solely responsible for all import duties, customs fees, taxes, and compliance with the laws of your country. These costs are not included in the purchase price and are not the responsibility of Morton Contemporary. Title and risk of loss transfer to you upon delivery to the carrier (see Section 6).
4. Ordering and Payment
When you confirm your order at checkout, you represent that all information provided is accurate and that you accept these Terms and Conditions in their entirety. You will receive an email confirmation once your order is placed and payment is verified.
Payment must be made in U.S. dollars. We accept major credit cards and other payment methods as listed at checkout. Payment is processed at the time of order placement.
Morton Contemporary reserves the right to cancel or refuse any order at its discretion, including orders from customers with unresolved payment disputes, or where our payment processor has flagged fraud indicators. In such cases, any charge will be promptly refunded.
5. Authenticity
All artworks sold through Morton Contemporary are original works or authorized reproductions, as described in each listing. Morton Contemporary represents in good faith the provenance and description of each work as provided by the artist. We do not make additional warranties regarding investment value, future appreciation, or fitness for any particular purpose beyond what is explicitly stated.
6. Shipping and Delivery
Artworks are carefully packed and typically shipped within 7 to 14 business days of order confirmation, though delivery timelines may vary based on destination and carrier availability. International shipments may take longer. Morton Contemporary will provide tracking information when available.
Transfer of Risk: Risk of loss or damage transfers to the buyer upon delivery of the artwork to the carrier.
Damage Upon Receipt: Please inspect your artwork carefully upon delivery. If you receive a damaged item, you must:
- Note any visible damage on the carrier's delivery slip (write "under protest" or "damaged");
- Photograph the damaged artwork and all packaging materials; and
- Notify Morton Contemporary by email at Debbie@mortoncontemporary.com within 48 hours of delivery with photos and a description of the damage.
Failure to follow this process may limit your ability to make a damage claim. For artwork damaged solely due to shipping, Morton Contemporary will cover return shipping costs. We will repair the artwork at our cost and return it promptly, or — if repair is not feasible or acceptable to the buyer — issue a full refund to the original form of payment, including return shipping costs, upon receipt of the artwork in its original packaging.
7. Returns and Refunds
General Returns (Change of Mind): If an artwork does not meet your expectations, you may return it within 7 days of delivery in its original, undamaged condition and packaging, accompanied by a copy of your invoice. Returns that meet these conditions will receive a full store credit with no expiration. The buyer is responsible for all return shipping costs and associated fees. We recommend insuring the shipment for the full purchase value. Morton Contemporary is not responsible for artworks lost or damaged in return transit.
To initiate a return, please email Debbie@mortoncontemporary.com for return instructions before shipping.
Hidden Defects: If an artwork has a hidden defect not disclosed at the time of sale and not visible in listing photographs, you must notify Morton Contemporary within 7 days of delivery with photographic documentation. Upon confirmation of a qualifying defect, Morton Contemporary will issue a full refund to your original form of payment upon receipt of the returned artwork in its original packaging. Morton Contemporary will cover return shipping in these cases.
Non-Returnable Items: Custom commissions and works specifically designated as final sale are not eligible for return or refund.
8. Intellectual Property and Copyright
All artworks available on this site are protected by copyright. The copyright in each artwork belongs to the respective artist. Morton Contemporary holds a limited license to display and market these works on this platform. The sale of an artwork conveys ownership of the physical object only and does not transfer any copyright, reproduction rights, or intellectual property rights to the buyer.
All website content — including text, images, logos, design elements, and branding — is the property of Morton Contemporary or its licensors and is protected by copyright and trademark law. No part of this website may be reproduced, distributed, modified, scraped, or used for commercial purposes without the express prior written consent of Morton Contemporary and, where applicable, the relevant artist.
9. Website Use
You agree to use this website only for lawful purposes and in accordance with these Terms. You agree not to: use any automated means (bots, scrapers, crawlers) to access or collect data from the site; attempt to gain unauthorized access to any portion of the site or its systems; transmit any harmful, offensive, or disruptive content; or impersonate any person or entity. Morton Contemporary reserves the right to terminate or restrict access to any user at its discretion.
The information on this website is provided for general informational purposes. While we strive to keep it accurate and current, we make no warranty that the site will be uninterrupted, error-free, or free of viruses or other harmful components.
10. Limitation of Liability
To the fullest extent permitted by applicable law, Morton Contemporary, its owners, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of this website, your purchase of artworks, or any other matter related to these Terms — even if advised of the possibility of such damages. Morton Contemporary's total liability for any claim arising from a transaction shall not exceed the purchase price paid for the specific artwork at issue.
Nothing in this section limits liability for fraud, willful misconduct, or any liability that cannot be excluded by law.
11. Disclaimer of Warranties
This website and all artworks and services are provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement, except as expressly stated in these Terms.
12. Dispute Resolution
In the event of a dispute arising from these Terms or any purchase, the parties agree to first attempt resolution informally by contacting Morton Contemporary at Debbie@mortoncontemporary.com. If the dispute is not resolved within 45 days, either party may pursue binding arbitration under the rules of the American Arbitration Association, conducted in Delaware County, Pennsylvania. Both parties waive the right to a jury trial or to participate in a class action proceeding. Notwithstanding the foregoing, either party may seek injunctive or equitable relief in a court of competent jurisdiction.
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict of law principles.
13. Privacy and Data Use
When you place an order or contact us, we collect personal information including your name, address, email address, and payment information as necessary to fulfill your order. We do not sell your personal information to third parties for their own marketing purposes.
We may use your contact information to send you order confirmations, shipping updates, and — with your consent — promotional communications. You may opt out of marketing emails at any time by clicking "unsubscribe" in any email or contacting us directly.
We may use hashed customer data (such as email addresses) to create custom advertising audiences on platforms such as Google Ads. This data is transmitted securely and is not used by those platforms for purposes beyond audience matching.
California Residents: You may have additional rights under the California Consumer Privacy Act (CCPA), including the right to know, delete, and opt out of the sale of personal information. Please contact us to exercise these rights.
EU/UK Residents: If you are located in the European Union or United Kingdom, your data is processed on the basis of contract performance and, where applicable, your consent. 14. SMS / Text Messaging
By providing your mobile number, you consent to receive SMS messages from Morton Contemporary, which may include order updates, customer support responses, and promotional offers.
- To opt out, reply STOP to any message. You will receive a confirmation and will not receive further messages unless you re-subscribe.
- For help, reply HELP or email Debbie@mortoncontemporary.com.
- Message and data rates may apply. Message frequency varies.
- Carriers are not liable for delayed or undelivered messages.
- Your mobile opt-in data is never shared with third parties for any purpose.
15. Modifications to These Terms
Morton Contemporary reserves the right to update or modify these Terms and Conditions at any time. Changes will be posted on this page with an updated effective date. Your continued use of the website or placement of an order after changes are posted constitutes your acceptance of the revised Terms.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision will be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, without affecting the validity of the remaining provisions.
17. Entire Agreement
These Terms and Conditions, together with any order confirmation and our Privacy Policy, constitute the entire agreement between you and Morton Contemporary with respect to your use of this website and purchase of artworks, and supersede all prior communications or agreements on these subjects.
